Terms of Service

The Service

The Clockwork Gradebook app and its companion website (the "Services") are provided for music educators to manage rehearsal planning, assessment, and student progress.

Licensing

Subscriptions grant a license for a single director. You may not redistribute, resell, or reverse-engineer the Services or their underlying code and formulas.

Refunds

Due to the digital nature of the Services, all sales are final. Subscriptions auto-renew until cancelled.

Acceptable Use

You agree to use the Services only for lawful educational purposes and to keep student data you enter accurate and appropriately authorized.

Privacy Policy

Data Minimization

We only collect the minimum data needed for rehearsal planning (e.g., director email, roster names, schedule info). We do not sell your data to third parties.

Student Privacy (FERPA / COPPA)

The Services are designed for director use. If student names or records are entered, the User (Teacher / School) acts as the agent for parental consent and is responsible for compliance with FERPA and COPPA. We keep all rehearsal data secure, private, and encrypted in transit via SSL / TLS. Students access their profile using a private code and do not create accounts or submit personal credentials.

Data Storage & Retention

Rehearsal data is stored on secured infrastructure and retained for as long as your account is active. You may request a copy of your data or its permanent deletion at any time by contacting us.

Security

We use industry-standard encryption to protect your account and rehearsal data in transit and at rest.

Your Rights

You may request export or permanent deletion of your data at any time. Withdrawal of consent does not affect processing carried out before withdrawal.

Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall the provider be liable for any indirect, punitive, incidental, special, consequential, or exemplary damages, including without limitation damages for loss of profits, goodwill, use, data, or other intangible losses, arising out of or relating to the use of, or inability to use, the Services.

Under no circumstances will the provider be responsible for any damage, loss, or injury resulting from hacking, tampering, or other unauthorized access or use of the Service or your account. In no event shall the provider's total liability to you for all damages, losses, and causes of action exceed the amount paid by you to the provider in the twelve (12) months preceding the event giving rise to the liability.
